Privacy Policy Jeans & Casual

1. General provisions

The online store Jeans & Casual (hereinafter referred to as the Executor) publishes this Privacy Policy (hereinafter referred to as the Policy) and undertakes to protect and respect the privacy of Users.

This Policy provides information, including personal data, that the Executor collects about Users in connection with the provision of services through its website, the purposes of collecting, the procedure for using and disclosing such information to third parties.

By registering on the website, the User accepts this Policy and voluntarily gives consent to the processing by the Executor, including collection, registration, accumulation, storage, adaptation, modification, updating, use and disclosure (disclosure, implementation, transfer) of depersonalization, destruction of their personal data (hereinafter - consent to the processing of personal data) in accordance with the Laws of Ukraine "On Protection of Personal Data", "On Protection of Consumer Rights", "On Protection of Information in Information and Telecommunication Systems".

The User has no right to use the Site if he does not agree with the terms of this Privacy Policy, or if he has not reached the age required by law to enter into agreements with the Executor.

If the User does not agree to the processing of his personal data by the Executor, he is obliged to terminate his registration on the Site unilaterally. The continued use of the Site by a registered user after the publication of this edition of the Policy on the corresponding page of the site means the consent of such User to the processing of personal data by the Executor.

This Policy is an appendix to the Service Agreement (hereinafter - the Agreement) and an integral part thereof.

If the User visits publicly available sections of the site, the Executor does not collect any personal information about him.

2. User information

When registering on the Site, the Executor asks Users to provide all necessary information to provide the services described in the Agreement.

The Executor has the right to collect the following information about Users:

  • surname, first name, patronymic;
  • place of residence;
  • Email address
  • history of the User's use of the Site (including message history)
  • technical information contained in the system, such as IP addresses.

In addition, the User has the right to use the site's services using a Facebook account or other social networks. When the User logs in using these social networks, the Executor has access to all visible information contained in the social network account in accordance with confidentiality.

However, the Executor may collect and use from the Facebook account or other social networks only such information as: user image, date of birth, email address, information about friends of the user who use the Site, as well as the user's page URL in social networks.

When the User visits the Site, the Executor collects certain data automatically, such as: IP address of the computer, browsers and version of the operating system, time and date of the User's access to the Site. This facilitates the operation and use of the Site by the User.

The Executor does not collect, use or store information about the user's VISA/MasterCard bank card numbers, which the User uses to pay for the services of the Executor. This data is processed by the WayForPay payment platform.

The Executor may also at its discretion collect information, including documents to verify the identity of users, prevent, detect and prevent fraud and illegal activities.

3. Collection and use of information

The above information is processed by the Executor based on the consent to the processing of personal data for the following purposes:

  • provision of services under the terms of the Agreement
  • detection and prevention of fraud and other illegal actions of Users using the Site
  • facilitating the use of the site and improving services;
  • informing about services, news and advertising offers by SMS and email.

The Executor may from time to time send Users promotional emails to the email address about the proposed services or announcements related to the site and the services of the Executor. The User can unsubscribe from such mailings by clicking on the appropriate link in the email and changing the settings of his profile.

The Executor retains the personal data of Users for as long as necessary for the necessary commercial purposes or for the performance of its legal obligations.

By this Policy, the User gives permission for other users to access his personal data solely for the purpose of concluding an agreement or to comply with the requirements of the relevant legislation.

4. Transfer and disclosure of information

The Executor undertakes not to disclose or transfer to third parties the personal data collected in the course of providing services and other information, except as described in this Policy.

The Executor has the right to disclose and transfer personal data to third parties in cases provided by law, and only (if necessary) for the benefit of national security, economic well-being and human rights, in particular, but not exclusively, if:

  • such actions are mandatory under the current legislation of Ukraine;
  • there are sufficient grounds to believe that the disclosure of such information is necessary to comply with the current legislation of Ukraine.

The procedure for access to personal data is determined by the Law of Ukraine "On Protection of Personal Data".

5. Information protection and Executor's liability

The Executor takes all necessary measures to ensure the protection of Users' personal data at all stages of their processing from unauthorized access, alteration, disclosure and destruction.

The Executor is responsible for all actions or inaction regarding the personal data of Users within the current legislation.

The Executor is not responsible for the actions of Users and third parties with personal data of Users, regardless of whether such data is obtained through the Site or by other means.

6. Other provisions

During registration, the User confirms that he will provide accurate, accurate information and update it as necessary.

If the User provides information that is false or inaccurate, or the Executor has reasonable grounds to suspect that such information is false or inaccurate, the Executor has the right to suspend the provision of services to the User or to terminate access to the Site.

If the Executor discovers information about a person that does not correspond to reality, such information is subject to change or destruction. Information about identity can also be changed at the reasoned request of the user. Such a request is considered by the Executor within 10 days from the date of its receipt. After the expiration of the storage period for personal data specified in section 3 of this Policy, the user's personal data is subject to destruction.

7. Changes to the privacy policy

This Policy may be changed or updated by the Executor at any time without any special notice to Users.

Any changes or additions to this Policy are effective only after the publication of a new edition of the Policy on the Site at jeansandcasual.com.ua/about/privacy-policy. The new edition of the Policy takes effect from the date of its publication on the Site, unless otherwise provided by the new edition of the Policy.

The Executor encourages users to periodically review the terms of this policy.

If the Executor has made any changes to the Agreement in the manner provided for in clause 11 of the Agreement, with which the User does not agree, he is obliged to stop using the Site and services of Jeans & Casual. The fact of using the site confirms the user's consent to the edition of the Agreement.

The continued use of the Site by a registered user after the publication of this edition of the Agreement on the corresponding page of the site means the consent of such user to change the Executor's obligations to provide services (Article 520 of the Civil Code of Ukraine) and indicates the acceptance of this Agreement in its current edition.
